When you place an order on www.natureszestnutrition.com ("the Website") you are subject to the following conditions set out below. By submitting an order on this website you ("the Customer") agree and accept to be bound by these conditions. These conditions are in addition to your statutory rights as a consumer and shall govern the contract to the exclusion of any other terms or conditions.

We reserve the right to change or modify these terms at any time including for legal, regulatory or security reasons. Whilst we will highlight changes on the website and/or send emails in relation to key changes, it is your responsibility to check the terms for changes. If you do not agree to any of the terms then you can simply stop using the website at any time. ORDER PROCESS & CONFIRMATION.

The placement of your order on our online store constitutes an offer to us to buy the products you select from www.natureszestnutrition.com. All orders are subject to availability and to acceptance by us. We reserve the right to refuse to accept an order. We will then send you an email confirming receipt of your order. All communications will be addressed to the email address you supply when you register on www.natureszestnutrition.com. Please note that this does not constitute acceptance by us. The contract for the purchase of the product is formed when we transmit to you an email dispatch confirmation.

You may select items from our range of products, details of which will be added to the "Shopping Cart” by clicking on the "Add to Cart" button. By clicking on the "Checkout" button in the Shopping Cart, you submit an offer to buy the goods in the Shopping Cart. As soon as this offer is accepted by us via an Acceptance Email (as described below) your order then forms a binding contract of sale between you and us.

Before placing an order you can view and amend your order details at any time by clicking on the "Shopping Cart".

You will automatically be sent an email confirming receipt of your order (the "Confirmation Email") with a summary of the details of your order, which we recommend that you print out and keep for your own records. The Confirmation Email does not constitute our acceptance of your order; it simply records the fact that we have received your order.

We will send a second email when we dispatch your goods which shall constitute our acceptance of your order (the "Acceptance Email") at which point a binding contract of sale will be concluded between you and us. We will file a copy of any orders that are accepted by us.

ORDERS AND QUOTES

In accepting a quote or submitting an Order Form for the goods the Customer acknowledges that: all information relating to the goods and any material produced by the Company is supplied in good faith, and the limitations of monitor capabilities and of printers means that the colour and dimensions of the products on our website may vary from the goods supplied to the Customer under the Contract. Any error in any quote, sales literature or any other document or information issued by the Company or placed upon our website may be corrected without any liability to the Company “provided that” if the price of the goods or a material difference in the specification of goods is varied between the date of acceptance of the Order and the Delivery Date the Customer shall subject to their statutory rights have the option to cancel their Order and a refund of the Total Price plus the reasonable and applicable cost of post and handling will be made available by the Company to the Customer.

The Company reserves the right by giving notice to the Customer at any time before receipt by the Company of the Customer's Order Form to increase the price of the Goods to reflect any increase in the cost to the Company which is due to any factor beyond the control of the Company (such as, without limitation, any foreign exchange fluctuation, currency regulation, alteration of duties or material increase in the costs of the goods to the Company). The Company reserves the right by giving notice to the Customer at any time before the Delivery Date to increase the Price of the Goods to reflect any change in quantities of the goods or delivery dates which is requested by the Customer, or any delay caused by any instructions of the Customer or failure of the Customer to give the Company adequate information or instructions.

PRICES & PAYMENT

The price of any product shall be as stated on our website at the time you place your order except in the case of an obvious error. We try and ensure that all our prices on our website are accurate but occasionally errors can and may occur. If we discover an error in the price of a product that you have ordered, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item to you. In those circumstances, we will inform you of the correct price to you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you do cancel then no payment will be debited from your card.

Please note we accept payment by Credit or Debit Card and Apple Pay or Google Pay.

Payment will be debited from your account at the time of or shortly before dispatch of your order.

You confirm that the credit/debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. Any fraudulent use of credit cards will be reported to the relevant authorities. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be responsible for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the Contract within 14 working days of the Delivery Date of the Goods by serving written notice of withdrawal and the Company shall credit the Customer's Credit Card for the Total Price of the Goods. The Customer shall pay the costs of returning the goods to the Company by the same method as they were delivered in the event that the Goods have been dispatched by the Company prior to receipt of the written notice of withdrawal.

CANCELLATION AND RETURNS

We do our utmost to ensure you are happy when shopping with www.natureszestnutrition.com. To ensure this we offer a "100% satisfaction" guarantee which allows you to return any “unopened item” within 14 days of the date when you received the order.

We will refund your original payment once we have received and processed the returned item (please allow up to 14 working days from date of postage). In order to arrange a return, please contact us by email and confirm your order number, the item you are returning and the reason for the return. We will then reply with a Return Auth Number authorising your return.

Please ensure that you package the item securely and include your original delivery note/invoice as this will allow us to process it promptly and efficiently. When returning an item please remember you ask the Post Office for a “Proof of Postage” receipt which you should keep as your proof of sending until you have received your exchange or refund.

YOUR CONSUMER RIGHTS COVER THE FOLLOWING

That product/s supplied by us will be of reasonable quality and fit for their relevant purpose and will be compliant with their description given on our website. A right to cancel your order within 14 working days, beginning from the day on which you receive your product, and to receive a full refund, even if the product is not defective in any way.

OWNERSHIP & RISK

Damage or risk loss of the goods shall pass to the customer on delivery or if the Customer fails to take delivery of the goods at such a time when the Company or its agent has used all practical efforts to deliver the goods. The title in the goods shall not pass to the Customer until the Company has received in cash/cleared funds payment in full of the Price of the Goods and all other Goods agreed to be sold by the Company to the Customer for which payment is then due. “As soon as the product is delivered to you, you are responsible for it”

COPYRIGHT AND INTELLECTUAL PROPERTY

Your usage of our website grants no rights to you in relation to design rights, copyright, trademarks or any other intellectual property rights or the intellectual property rights of any third party.

We provide this website to you solely for your personal, non-commercial use. You may electronically copy and print only those areas of the website which are required in the process of using our website as a shopping resource. The content of our website may not be used for any other purpose without our written permission.

WARRANTIES, LIABILITY AND INDEMNITY

Nothing whatsoever in this clause shall exclude the Company's liability for death or personal injury caused by its negligence. Subject to the conditions set out below the Company warrants that all Goods will correspond with the Order at the Dispatch Date and will be free from defects upon delivery. If the Company is in breach of the warranty contained at clause above, then the Customer shall advise the Company in writing immediately and in any case not later than 14 working days from the Delivery Date. If delivery is not refused, and the Customer does not notify the Company accordingly, the Customer shall not be entitled to reject the Goods and at the Company's reasonable discretion the Company shall have no liability for such defect or failure, and the Customer shall be bound to pay the Price as if the Goods had been delivered in accordance with the Contract. On receiving a notice the Company will replace all or any part of the defective Goods or refund the price of those Goods which are found to be defective.
